Two audiences, one document. Part A is for clients booking talent. Part B is for talent we represent. Where a booking is confirmed, the booking contract and the usage licence issued for that job sit on top of these terms and take priority over them.
For clients booking talent
Who these terms are between
Pink Mayhem LLC acts as agent for the artist. The contract for the booking is between the client and the artist, and Pink Mayhem contracts as the artist's agent. Pink Mayhem is responsible for arranging the booking, issuing the paperwork, invoicing you and paying the artist. It is not the artist's employer.
Pink Mayhem does not procure employment for artists in any state where it is not licensed to do so. Where a booking would require a licence Pink Mayhem does not hold, it will not accept the booking.
How a booking is made
Six steps, in this order, every time:
- Brief. You send dates, location, intended usage and budget. We tell you the same day whether it is a job we can take.
- Shortlist. Digitals, measurements and day rates come back within one working day.
- Option. We hold your chosen artist for 48 hours at no charge.
- Confirm. A booking contract, a usage licence and a call sheet are issued and countersigned.
- Shoot. A contact is reachable for the whole shoot day.
- Invoice. Invoiced on wrap, payable in 30 days.
No artist is committed and no money moves until step 4 is complete. Anything agreed by email before that point is an enquiry, not a booking.
Option holds
An option is a free 48-hour hold on an artist's availability. First option beats second: if a second client wants the same artist on the same dates, the first option holder is given the chance to confirm or release. Options expire automatically and are not a booking.
Fees and what they buy
A booking fee buys the artist's time on the dates agreed. It does not transfer any right in the resulting images. Rights are granted only by the usage licence issued with the booking.
Day rates are quoted per artist, per day, and are exclusive of the licence fee, expenses and any agency fee shown separately on the quote. Fittings, travel days and rehearsal days are booked and charged separately.
The usage licence
Every confirmed booking carries a licence scoped to three things: territory, term and media. The licence issued with your booking is the one that governs it. Unless the licence says otherwise:
- The licence is non-exclusive.
- It begins on the date of first publication, not the shoot date.
- It does not include use as a trade mark, use implying personal endorsement, or use in a political, religious or advocacy context.
- It does not permit alteration of the artist's likeness beyond ordinary retouching, and it does not permit use of the images to train a machine-learning model.
- All rights not granted are reserved to the artist.
Extensions are quoted in advance. Ask before the licence expires and it is a quote; ask afterwards and it is the clause below.
Unauthorised use
Use outside the licensed territory, term or media is unlicensed. Unlicensed use is charged at three times the licence fee that would have been quoted for that scope, and does not become licensed until it is paid. This is not a penalty; it reflects that unlicensed use removes the artist's ability to negotiate and may conflict with exclusivity granted elsewhere.
Cancellation by the client
- More than 48 hours before call time — no fee.
- Between 24 and 48 hours before call time — 50% of the agreed day rate.
- Less than 24 hours before call time, or the client does not proceed on the day — 100% of the agreed day rate.
Fees already incurred on the client's instruction — travel booked, fittings attended, third-party costs committed — are payable in every case, including where no cancellation fee applies.
Postponement and weather
A postponement to a specific new date agreed within 48 hours of the original call time is treated as a rebooking, not a cancellation, provided the artist is available. If the artist is not available for the new date, the cancellation scale above applies. Weather-dependent shoots can be booked with a first-refusal weather day at the time of confirmation; without one, a weather cancellation is an ordinary cancellation.
Overtime and expenses
A booking day is eight hours including breaks, from the call time on the call sheet. Overtime is charged in 30-minute units after the eighth hour at the pro-rata day rate, and must be agreed in writing on the day by the person named on the call sheet. Travel outside the booked location, accommodation, and any wardrobe or grooming costs the client asks the artist to bear are charged at cost.
Invoicing and late payment
Invoiced on wrap, payable within 30 days by bank transfer. Licensed usage begins once the invoice clears. Overdue sums carry interest at 1.5% per month from the due date until paid. We may withhold delivery of images, or suspend a licence, while an invoice is overdue.
What the client is responsible for on the day
- A safe place of work, and somewhere private to change that is not a public area.
- The brief as booked. Wardrobe, styling and the nature of the work must match what the artist agreed in advance. Anything else needs the artist's agreement on the day, in writing.
- Nudity, partial nudity, lingerie, swimwear and any physical contact must be agreed in the booking contract before the day. They cannot be introduced on set.
- No request that the artist sign a release, waiver or additional licence on set. Paperwork is issued through Pink Mayhem before the shoot.
- Meals and breaks on any booking over six hours.
If the work on the day is not the work that was booked, the artist may leave and the full day rate remains payable.
Liability
Pink Mayhem is liable for arranging the booking as agreed. It is not liable for the artist's performance beyond using reasonable care in selecting and briefing them, and it is not liable for a client's production costs, studio hire, crew costs or lost profit if a booking cannot go ahead. Where an artist cannot attend, Pink Mayhem will offer a replacement of comparable suitability where one is available; if none is, the booking fee is refunded. Nothing in these terms limits liability for fraud, or for anything that cannot lawfully be limited.
Complaints
Email info@pinkmayhem.co with the booking reference. We will acknowledge within two working days and respond substantively within ten.
For talent we represent
No sign-up fee, no portfolio package, no course, no administration charge, no fee for being considered. If anyone asks you for money in Pink Mayhem's name, it is not us — email info@pinkmayhem.co.
Representation agreement
Representation is set out in a written agreement with a defined term and a notice period, signed before we put you forward for anything. These terms of business sit underneath that agreement; where the two differ, your agreement wins. You get a copy, and you are entitled to take advice on it before signing.
What Pink Mayhem will never charge you
Pink Mayhem does not charge artists any fee for finding work, for being considered, for being on the board, or for any portfolio, course, image package or administrative service. Pink Mayhem is paid a commission by deduction from fees the artist earns, and only after those fees have been received. The commission rate is stated in your representation agreement.
Where a client requires new digitals or test shots for a specific job, who pays is agreed with you in writing before it is arranged. It is never deducted from you without your agreement.
Your right to refuse work
An artist may refuse any booking, for any reason, without it affecting their representation. You see the full brief before you say yes — the job, the client, the wardrobe, the usage and the fee. Nudity, partial nudity, lingerie, swimwear and physical contact are never agreed on your behalf and are never assumed from a previous job.
Payment to you
You are paid within 5 working days of the client's invoice clearing, straight to your account, with a statement showing the fee, the licence element, the commission deducted and any expenses. If a client pays late, we tell you; we do not go quiet. If a client does not pay, we pursue it, and we tell you what is happening.
You are engaged as an independent contractor unless a specific booking says otherwise. You are responsible for your own taxes, and we will issue the tax documentation required for the payments we make to you.
Your image and your rights in it
The artist owns the copyright position in their likeness as against Pink Mayhem. Pink Mayhem takes only the rights needed to market the artist and to grant the licences described in each booking. Your images are licensed, never sold. We do not license your likeness for machine-learning training, and we do not agree endorsement use without asking you first.
Ending the agreement
You can end your representation by giving the notice period in your agreement, in writing. Bookings already confirmed before your notice takes effect go ahead, and commission on those bookings is still payable. Nothing else is. We do not charge an exit fee, we do not hold your images hostage, and we will confirm in writing what we are keeping and for how long — see the privacy notice.
Applying to both parts
Minimum age
Pink Mayhem represents adults only. Minimum age 18, verified by photo identity document at application. We do not represent children and do not accept bookings for child performers.
Force majeure
Neither party is in breach for a failure caused by something outside its reasonable control. Where that prevents a booking going ahead, the parties will agree a new date in good faith, and costs already committed on either side remain that party's own.
No partnership
Nothing in these terms creates a partnership, joint venture or employment relationship between Pink Mayhem, a client and an artist beyond the agency relationship described in Part A.
Changes to these terms
We may change these terms. The version in force for a booking is the version published when the booking was confirmed. Changes are never applied retrospectively to a confirmed job or to commission already earned.
Governing law
These terms are governed by the law of the State of Wyoming, and the courts of Sheridan County, Wyoming have jurisdiction. Where a booking takes place in another state, the mandatory protections of that state's law for artists and performers apply in addition, and nothing in these terms is intended to waive them.
